TERMS & CONDITIONS

1. General Overview

These Terms and Conditions (“Terms”) govern all photography, videography, product content creation, and related services (“Services”) provided by Lambda Product Content (“the Company”) to the Client (“the Client”).
By engaging our Services, the Client acknowledges that they have read, understood, and agreed to these Terms in full.

2. Booking & Deposit

2.1 A booking is only confirmed once a 60% non-refundable deposit has been received.
2.2 The remaining 40% balance is payable upon completion of the project and before the release of any final content.
2.3 Deposits secure the Client’s booking date and are non-transferable.
2.4 Failure to pay the deposit within the agreed timeframe may result in the booking slot being released to other clients.

3. Pricing & Scope

3.1 All pricing is quoted per individual image. Each unique angle, setup, or product variation is considered a separate image and will be billed accordingly.
3.2 Videography, motion graphics, or post-production work are quoted separately.
3.3 Any additional requests outside the original brief (e.g., reshoots, layout changes, or alternate edits) will be subject to additional charges.
3.4 All quotations remain valid for 14 calendar days unless otherwise stated.

4. Cancellation & Rescheduling

4.1 Cancellations made after the deposit has been paid will result in forfeiture of the deposit.
4.2 Rescheduling requests must be submitted at least 48 hours in advance and are subject to availability.
4.3 If Lambda Product Content cannot complete the project due to illness, equipment failure, or unforeseen circumstances (force majeure), the Client will be entitled to a full reschedule or refund of any amounts paid, excluding any completed work.

5. Content Ownership & Copyright

5.1 Unless expressly agreed in writing, all intellectual property rights and copyright in photographs, video, and other creative content produced by Lambda Product Content remain the sole property of the Company.
5.2 The Client is granted a non-exclusive, perpetual license to use the final, edited deliverables for marketing, advertising, and promotional purposes directly related to their brand or products.
5.3 Raw or unedited files are not included in the license and will not be provided unless specifically agreed upon in writing and subject to an additional fee.
5.4 Lambda Product Content retains the right to use any content created — including images, video, and behind-the-scenes footage — for its own marketing, website, portfolio, and social-media promotion, unless the Client provides a written objection before the project commences.

6. Client Responsibilities

6.1 The Client is responsible for providing all products, props, and materials required for the shoot in a timely and presentable condition.
6.2 Delays or reshoots caused by damaged, incomplete, or late product delivery may incur additional costs.
6.3 The Client warrants that all materials provided (such as designs, packaging, and labels) do not infringe upon any third-party copyrights or trademarks.

7. Delivery & File Retention

7.1 Final edited images and videos will be delivered digitally via download link, shared drive, or other agreed-upon method.
7.2 Standard turnaround time is approximately 5–10 business days from the shoot date, depending on project size and complexity.
7.3 Lambda Product Content retains final files for 30 days after delivery. Retrieval beyond this period may be subject to an archive fee.

8. Revisions & Reshoots

8.1 The Client is entitled to one round of minor revisions to the final deliverables. Additional revisions or major alterations will be billed at the prevailing hourly rate.
8.2 Reshoots due to Client-requested changes in product, styling, or creative direction after completion of the shoot will be treated as a new booking.

9. Liability & Indemnity

9.1 While every effort is made to ensure quality and reliability, Lambda Product Content shall not be held liable for loss, damage, or delays beyond its reasonable control.
9.2 The Client agrees to indemnify and hold harmless Lambda Product Content, its employees, and subcontractors from any claims, damages, or expenses arising out of materials provided by the Client.

10. Governing Law

These Terms are governed by and interpreted in accordance with the laws of the Republic of South Africa. Any disputes arising shall be subject to the jurisdiction of the South African courts.

11. Acceptance of Terms

By paying a deposit, submitting a booking, or accepting a quotation from Lambda Product Content, the Client acknowledges that they have read, understood, and agreed to all Terms and Conditions contained herein.
